Man this is going to come down to some philosophical debate about freedom over order. You see about 95% (this number is arbratry) of all people even criminals do not want to do bad things. Most criminals have limited options in their life and turn to crime as a means to survive.
So, to make stories more interesting more and more we see good guys fighting good guys instead of good vs evil. Neither side wants things to fall into chaos and disorder and neither side feels right about killing people. The only difference is the lengths each is willing to go to in order to keep the peace.
If Batman wins there will be rampant chaos where criminals will run wild since the world government has been over thrown. What keeps people from doing crazy things like killing each other and stealing is not laws, but informal social norms. If the norms dictate the police are not to be trusted than no laws will be followed.
If Superman wins there will be great restraints put on every citizen depending on how extreme the regime is. The problem will be the police will focus on suppression and not prevention. Since a few commit crimes all will suffer. Forget things like privacy and owning a gun. What such a regime would effect the most is the poorest of the poor, because that is where most of the visible criminals would come from. There would be massive arrest in bad areas and its populace would be hounded by the police.
Since I am a law abiding, middle class, white American citizen I think the most the regime would give me would be a headache because of new procedures. So, I'm going to vote for them.
